Troopers Wrestle with Intoxicated Ohio Man at ACMH

A northeastern Ohio man is being held in the Armstrong County Jail after allegedly assaulting two Pennsylvania State Police troopers and violating several driving laws a few weeks ago.

David Foust, 33 of North Canton, is charged with 10 crimes – including two felony-grade counts of aggravated assault and a felony charge of simple assault – after an incident along Route 422 East and in a triage room at ACMH Hospital in East Franklin Township.

According to a Pennsylvania State Police affidavit filed before District Magisterial Judge Gary DeComo, troopers conducted a traffic stop about 10:15PM on Foust in his beige 2005 Nissan Xterra August 4 along State Route 422 East in South Buffalo Township after troopers observed it cross over the road’s fog line twice.

Foust “displayed glassy bloodshot eyes and had a smell of an alcoholic beverage emitting from his breath and inside the vehicle” according to the report and was given a standardized field sobriety test – when he was found to be under the influence. Foust admitted to being on suboxone and anti-depressants and was also found to be positive for alcohol based on a portable breath test.

After being arrested for suspected driving while under the influence, Foust was transported to ACMH for a blood test – where he was left with two assisting State Police troopers while two viles of blood were taken from Foust’s left arm.

Foust then began yelling obscenities as troopers prepared the paperwork and blood kit, causing several ACMH staff members to run into the triage room to check on the situation. Foust also allegedly took an aggressive stance toward troopers before kicking one in the leg and spitting at the other.

A wrestling match reportedly ensued before the assisting troopers were able to restrain Foust and transport him to the State Police barracks in Kittanning.

Foust waived his right to a preliminary hearing Thursday and is being held on $20,000 monetary bail.
