Local Drunk Driving Conviction Overturned

Local Attorney Jason Lewis’filed an appeal before the Superior Court in July that overturned the DUI conviction of Lance Jablonski.

A Kittanning man has been found not guilty of driving under the influence and other charges after appealing his case in a higher court.

Lance Stephen Jablonski was convicted of the crimes within the Armstrong County Court of Common Pleas, but Jablonski filed an appeal with the Superior Court in July 2014.

According to Jablonski’s attorney, Jason Lewis, Jablonski was found by police in the parking lot of a private club with the keys in the ignition and the engine running.

However, there was found to be no evidence that the car had moved or that Jablonski attempted to move the vehicle while intoxicated.

“The opinion rendered by the Superior Court is exactly what we had hoped for,” Lewis wrote in a news release. “It followed prior rulings by the Pennsylvania Superior Court that I felt were very similar, factual circumstances when compared with what happened to Lance. After three years of arguing this point, it is very gratifying to get to this result.”

Honorable Judges John T. Bender, Patricia H. Jenkins and John L. Musmanno heard the case and filed the decision. The docket has been officially vacated and the decision will stand.

    Common sense. He was on private property and he wasn’t driving. Why did so much money and court time have to be spent on this?
