Sewage Authority Agrees to Pay Court Settlement

 

Ford City Borough Municipal Sewage Disposal Authority officials formally agreed to comply with a court ruling made last week.

Following an executive session at the wastewater treatment plant last night, board members unanimously passed a motion to accept and have Sewage Authority President John Thompson sign a Settlement and Mutual Release Agreement and pay $395,224.03 to S&E Utility Contracting, Inc - of Harrison City (Westmoreland County).

January 19, a jury awarded S&E Utility Contracting the payment during a civil court trial resulting from the Ford City authority’s breach of the parties’ agreement. The lawsuit stemmed from work (or lack thereof) performed during the sewer separation project in Ford City Borough.

When asked to comment on the results of the lawsuit, Thompson made a brief statement.

“Until the Settlement and Mutual Release Agreement is signed by both parties and agreed to by parties, (there is) no public statement and no public release of document,” Thompson said.

Thompson declined further comment.

After the meeting adjourned, Ford City Resident Jerry Miklos was disappointed no public comments were taken.

“Terrible – terrible,” Miklos said. “I think it’s a shame to waste the public’s time like this. (The special meeting) provided no information what so ever.”

Regarding the lawsuit verdict, Miklos said it will be “a terrible burden…on the sewage rate payers in Ford City Borough and Manor Township.”

“A disaster all the way around,” Miklos concluded.

The sewage authority regularly meets the second Thursday of each month at 7PM in the borough office along 4th Avenue.
